STANDARD CREATOR LICENSEUSER AGREEMENT
By accessing or using this service you agree to be bound by these Terms of Use. If you disagree with any part of these Terms of Use then you may not access this service.IMPORTANT
• All communication will be done through the VGen site unless stated otherwise.
• The clients request will be held for 7 days after sending the payment notice. If no payment is received after 7 days, the clients order will be cancelled.
• If the client does not respond to progress updates within 7 days, it will be considered as approval to proceed to the next stage or make the final delivery.PAYMENTS
• Payments are processed via VGen
• ONLY accepting full paymentsPROCESS
• After placing an order, the client will recieve 2 sets of progress to review and make changes: (1) sketch/lineart and (2) flat colours/render
• One set of revisions can be made during these 2 steps, however, excessive/complex revisions will incur additional fees
• No changes will be made after the final piece is completed
• Each commission can take from 1-4 weeks after marked as 'WIP'USAGE POLICY & LICENSING
These licenses are catered towards independent creators. For Game Studios & Companies, please refer to my Game Studio & Interactive Media License or contact me before commissioning.Promotional License: branding & promotional material (i.e. streaming sites, social media, etc.)
• Files available in HQ resolution
• You do not own the rights to this artwork
• You have the right to use the completed artwork for personal use, streaming and social media
• You MAY NOT edit, copy, duplicate, redistribute or resell this product to third partiesMerchandise License: physical & digital merchandise (i.e. deskmats, prints, stickers, etc.)
• Files available in HQ resolution
• Includes source files
• You may edit, copy, duplicate this artwork
• You may redistribute or resell this product to third parties as merchandise only
• The artwork may not be used for NFT, Blockchain, AI training, or AI-generated content purposes.PRIVACY POLICY
• If you require an NDA for your commission request, please specify
• Non-disclosure agreements protect your commission from being disclosed until a specified dateREFUNDS
A refund can be issued if:
✓ The commission cannot be delivered for any reason
✓ The commission is cancelled BEFORE I start working on it

• Please provide credit by using my username/twitter handle (@qwerqcreative) or twitter link (not required with merchandise license but would be appreciated)
• Commissions are selective and not first come first serve
• I reserve the right to use the commissioned artwork as part of my portfolio
• I reserve the right to exhibit the artwork (meaning that I can post all artworks to my social media and use for publicity)
• I reserve the right to refuse service to anyone for any reason at any time
• I will not profit further for the commissioned artwork unless the client breaks the terms of service
• All projects are handled as digital goods, meaning no physical items will be shipped
• You MAY NOT use the artwork to promote discriminatory, political, religious or violent topics
• The artwork MAY NOT be used for NFT, Blockchain, AI training, or AI-generated content purposes.
• Commissions containing copyrighted characters (i.e. anime/ game characters, etc) will be used under the discretion of you, the client. I will not be liable for any actions taken against you due to copyright violations
• These terms are subject to changeCHARGEBACK
Should the client issue a chargeback:
• Your rights to all commissioned artworks will be retracted
• I will have the right to profit further from all commissioned artworks in any way I see fit
• You will no longer have access to my services indefinitelyIf you ever have any issues with your order please contact me so that we can discuss the problem and resolve it privately and respectfully. I will of course try my best to help you and ensure that you are satisfied with your orderThank you for reading!
GAME STUDIO & INTERACTIVE MEDIA LICENSEThis license applies to all commissions purchased by companies, studios, teams, or individuals intending to use the commissioned artwork or animation within a video game or other interactive media product. By commissioning the artist, the client agrees to the terms outlined below.SCOPE OF LICENSE
• This license grants a non-exclusive, perpetual license to use the commissioned artwork or animation as an in-game asset within one (1) video game title.
• Permitted in-game uses include, but are not limited to: UI elements, menu screens, transitions, splash screens, and similar interactive visual content.
• The license also permits use of the asset in promotional materials directly related to the game, including trailers, store pages (e.g. Steam), press kits, and social media posts.
• All copyrights and intellectual property rights remain with the artist.RESTRICTIONS
• The commissioned asset may not be resold, sublicensed, shared, or redistributed as a standalone file.
• The asset may not be reused in other games, sequels, prequels, DLC, expansions, updates, remasters, or interactive projects without a separate written agreement.
• Use of the asset in ports to additional platforms (e.g. console, mobile) may require a separate license or written permission.
• The asset may not be extracted, datamined, or otherwise made directly accessible to end users.
• The asset may not be used for NFT, Blockchain, AI training, or AI-generated content purposes.PAYMENT & FEES
• Game studio commissions require a separate commercial fee distinct from creator or streamer pricing.
• Payment terms may be split into agreed milestones (e.g. 50% upfront / 50% upon final delivery).
• Final deliverables and source files (if applicable) will be released only after full payment has been received.
• All payments are processed through VGen unless otherwise agreed in writing.SALES, ROYALTIES & MILESTONES
• This license does not include ongoing royalties by default.
• Any revenue share, sales-based bonuses, or milestone payments must be explicitly agreed upon in writing and do not constitute an ongoing royalty obligation unless stated otherwise.
• Sales-based bonuses, if agreed, are one-time payments and may be capped at a maximum amount.CREDITS
• Where in-game or public-facing credits are present, the artist must be credited by username or handle (@qwerqcreative) unless otherwise agreed.ARTIST RIGHTS
• The artist retains the right to display the commissioned work in portfolios, social media, and promotional materials.
• The artist retains the right to decline future work or revoke this license in the event of chargebacks or material breach of these terms.REFUNDS & CANCELLATIONS
• Refunds are only available if the commission is cancelled before work has begun or if the commission cannot be completed for any reason.
• No refunds will be issued once work has commenced.LIMITATION OF LIABILITY
• The artist is not responsible for legal issues arising from the client’s use of copyrighted characters, trademarks, or third-party intellectual property.
• The client assumes all responsibility for how the asset is used within the game.CHARGEBACKS
Should the client issue a chargeback:
• All rights granted under this license are immediately revoked.
• The artist retains the right to use, resell, or otherwise profit from the commissioned work.
• The client will permanently lose access to the artist’s services.MODIFICATIONS & GOVERNING TERMS
• Any modifications to this license must be agreed upon in writing.
